§ 15-9. Wine, nonintoxicating beer or malt liquor—Consumption by permit.

  • (a)

    Consumption of wine, nonintoxicating beer or malt liquor shall be allowed on a permit basis in and within an area 25 feet from the following shelter houses or other designated park areas:

    (1)

    All shelter houses in Harley Park.

    (2)

    All shelter houses in Lions Park.

    (3)

    Frederick T. Kemper Park West Parade Field.

    (4)

    Rolling Hills Concession Area.

    (b)

    Consumption of wine, nonintoxicating beer, malt liquor within Rolling Hills Park shall be to limited to wine, nonintoxicating beer and malt liquor sold by the licensed concessionaire or approved organization, and only in those areas surrounding the concession stand and bleachers, excluding the parking lot as designated by the director of parks and recreation, except that during special events not related to softball, the director of parks and recreation may designate the ball field area for consumption of wine, nonintoxicating beer and malt liquor. Those consuming wine, nonintoxicating beer and malt liquor shall conform to all other local, state and federal laws, including but not limited to, disorderly conduct and littering.

    (c)

    Consumption of wine, nonintoxicating beer and malt liquor on the West Parade Field of the Frederick T. Kemper Park will only be allowed in conjunction with special events as recommended by the park and recreation director and approved by the city administrator.

    (d)

    All permits shall be signed by an adult 21 years of age or older who will be held responsible for the actions of anyone consuming wine, nonintoxicating beer, or malt liquor under the permit. All permits shall be inclusive of any shelter house reservation fee, and shall run concurrently with the reservation of the shelter house and shall be for no more than one day. All permits shall be on a form approved by the city administrator and must contain all information requested.

    (e)

    Possession of the permit does not allow the permit holder or any member of his/her party to violate any local, state, or federal laws, including but not limited to disorderly conduct, littering and/or the prohibition against open containers as defined in section 14-90 of the City Ordinances.

    (f)

    Issuance of a permit for the Frederick T. Kemper Park West Parade Field shall be performed on a case-by-case basis as recommended by the park and recreation director and approved by the city administrator.
