§ 21-95. Variance from maximum concentrations.

  • By written request to the superintendent, a person may apply for a variance from maximum concentrations of certain pollutants with limits as listed in this section:

    (1)

    Such a request may be considered for approval providing all the following conditions are met:

    (a)

    The discharge will not violate, will not cause the sewage treatment plant effluent to violate, or will not cause the watercourse into which the sewage treatment plant effluent discharges to violate any applicable local, state and federal regulations.

    (b)

    The public sewers and sewage treatment plant have adequate capacity for proper conveyance and treatment of the discharge.

    (c)

    Payment for treatment of the discharge is made in accordance with the existing rates including appropriate surcharge amounts to match the costs of treating the pollutants in concentrations in excess of those listed in section 21-94.

    (d)

    Maximum concentrations of the pollutants listed in this section are not exceeded.

    (2)

    Upon favorable consideration of the request, a written permit of variance will be provided. This permit of variance will be subject to withdrawal 90 days after notification should any of the conditions given in this section not be met or should the superintendent determine the variance inappropriate. Permits of variance may be issued for the following pollutants within limits as follows:
