§ 2-5. Corporate limits and annexations.

  • (a)

    The following described territory having been duly approved by the voters at a special election held on August 30, 1927, constitutes the corporate limits of the city.

    Beginning at a point 20 chains south of the northwest corner of the northeast quarter of section 3, township 48, range 17; thence north 20 chains to the southwest corner of the city limits of said City of Boonville as now established; thence north following the quarter section line to the north boundary line of Cooper County, Missouri; thence eastwardly along said north boundary line of said Cooper County, to a point on said line north of the middle of Lilly's Branch; thence south to and along the middle line of said branch with the meanderings thereof, to the intersection of the middle line of said branch, with the south line of the southeast quarter of section 25, township 49, range 17; thence south parallel with the east boundary line of the City of Boonville as now established, to a point 20 chains south, and 29 chains east of the northwest corner of the northeast quarter of section 1, township 48, range 17; thence westwardly 29 chains to a point 20 chains south of the government stone which designates the northeast corner of the northwest quarter of section 1, township 48, range 17; thence west parallel with the southern boundary line of the City of Boonville, as now laid out and established, 160 chains to a point 20 chains south of the northwest corner of the northeast quarter of section 3, township 48, range 17, the place of beginning. All in sections 1, 2, and 3, township 48, range 17, and sections 25, 26, 31, 35, and 36, in township 49, range 17, west of the Fifth Principal Meridian, Cooper County, Missouri.

    (b)

    Pursuant to the special election held on November 5, 1963, the corporate limits of the city do now include the following annexed adjacent territory:

    AREA NO. 1

    Beginning at a point twenty (20) chains South and twenty-nine (29) chains East of the northwest corner of the northeast quarter of Section one (1), Township forty-eight (48), Range seventeen (17); thence South thirteen and one-half (13 ½) chains; thence westerly twenty-nine (29) chains to a point thirty-three and one-half (33 ½) chains south of the Government Stone which designates the northeast corner of the northwest quarter of Section one (1), Township forty-eight (48), Range seventeen (17); thence West parallel with the southern boundary line of the City of Boonville as now laid out and established, one hundred sixty (160) chains to a point thirty-three and one-half (33 ½) chains south of the northwest corner of the northeast quarter of Section three (3), Township forty-eight (48), Range seventeen (17); thence North thirteen and one-half (13 ½) chains to the southwest corner of the city limits of Boonville as now established and bounded; thence East along the south boundary line of the City of Boonville, Missouri, as now established, to the place of beginning; containing 216 acres, more or less. All in Sections one (1), two (2) and three (3), in Township forty-eight (48), Range seventeen (17) and in Sections twenty-five (25) and thirty-six (36) in Township forty-nine (49), Range seventeen (17), of Cooper County, Missouri.

    AREA NO. 2

    Beginning at the southwest corner of Boonville, Missouri, as now established; thence South thirteen and one-half (13½) chains; thence West twenty (20) chains; thence North and parallel to the Western City Limits to the middle of the Missouri River, to the Cooper County Line; thence Easterly to the northwest corner of the present City Limits of Boonville, Missouri; thence South along the west boundary line of the City Limits of Boonville, Missouri, to the point of beginning; containing 180 acres, more or less. All in Section three (3), Township forty-eight (48), Range seventeen (17), and Section thirty-four (34), Township forty-nine (49), Range seventeen (17), of Cooper County, Missouri.

    AREA NO. 3

    Beginning at the southwest corner of Boonville, Missouri, as now established; thence East along the south boundary line of the City of Boonville, Missouri, as now established forty (40) chains, more or less, to a point four hundred (400) feet east of the center line of Missouri State Highway Number Five (5); thence Southerly parallel to the centerline of said Highway a distance of seventy-two and one-half (72½) chains, more or less; thence Westerly on a line extended which bounds the Boonslick fairgrounds on the South fifty (50) chains to the West right-of-way line of the Missouri, Kansas and Texas Railroad; thence Northerly one hundred twenty (120) chains, more or less, to the point of beginning; containing 420 acres, more or less. All in Sections two (2), three (3), nine (9) and ten (10), Township forty-eight (48), Range seventeen (17), and Section thirty-four (34), Township forty-nine (49), Range seventeen (17), in Cooper County, Missouri.

    (c)

    Pursuant to the special election held on April 2, 1968, it is hereby found, declared and determined that the corporate limits of the city have been duly extended to include, and do now include, the following annexed adjacent territory:

    Beginning at the Southwest corner of the City of Boonville, Missouri, as now established, which point is on the west right-of-way line of the Missouri-Kansas and Texas Railroad, on the quarter section line running East and West through Section nine (9), Township forty-eight (48) North, Range seventeen (17) West 5th P.M., thence East on said quarter section line to the East right-of-way line of Missouri-Kansas and Texas Railroad which is the point of beginning of the tract of land herein described, thence running Southwesterly with the said East right-of-way line of said railroad to a point on the North line of the Southwest quarter of the Southwest quarter of said Section nine (9), thence East to a point on the North line of the Southeast quarter of the Southwest quarter of said Section nine (9) which point is also the Northeast corner of a five (5) acre tract of land as conveyed by Carl Hasenbach and wife to John M. Davis and wife by deed recorded in Book 133, Page 482 of the Deed Records of Cooper County, Missouri, running thence South on the East line of said Davis tract (which is also the West line of a tract of land now owned by Davis, Johnston and Patrick Sales and Commission Company) to the North right-of-way line of U.S. Interstate Highway No. 70, thence continuing South on a straight line, being the extension of said Davis east line, 300 feet to the South right-of-way line of said U.S. Interstate Highway No. 70, thence Easterly along the South right-of-way line of said U.S. Interstate Highway No. 70, 97.57 chains to a point 300 feet South of the Southeast corner of a parcel of land conveyed by Ralph Snider and wife to School District R-1 of Cooper County, Missouri, by deed recorded in Book 134, Page 635 of said Deed Records, thence North 300 feet to the above mentioned Southeast corner of said school tract which is on the North right-of-way line of U.S. Interstate Highway No. 70, which point is also on the half section line running North and South through Section ten (10), thence North along said half section line, (which is also the East line of lands owned by said School District R-1, Earl Johnson and wife, and Maggie Helmriech, et al) to a point on the line of the present city limits as now established, which point is 400 feet East of the center line of Missouri State Highway No. 5, thence Southwesterly along said present city limit line to a point on the South line of the Northwest quarter of Section ten (10), it being also the South city limit line in Section ten (10) as now established, thence Westerly on said South line of the Northwest quarter of Section ten (10) and the South line of the North half of Section nine (9) (present City Limit line) 50.00 chains, more or less, to the East right-of-way line of said Missouri-Kansas and Texas Railroad, the point of beginning, containing in all 440 acres, more or less, and situated in Sections nine (9), ten (10), fifteen (15) and sixteen (16), Township forty-eight (48) North, Range seventeen (17) West 5th P.M. in Cooper County, Missouri.

    (d)

    Pursuant to the special election held on April 1, 1969, the following territory is hereby annexed to the city:

    Starting on the West line of State Route "B" (also known as the Boonville and Tipton Public Road) as now located, at that point where said line intersects the North line of the Southeast Quarter of Section two (2), Township 48, Range 17, it also being the South city limit line of the City of Boonville, as now located, running thence southwestwardly along the West line of said road to a point on the South line of the North half (½) of the Southeast Quarter of said Section two (2), running thence West on the South line of the North half (½) of the Southeast Quarter and the South line of the Northeast Quarter of the Southwest Quarter of said Section two (2) to the Southwest corner of the Northeast Quarter of the Southwest Quarter of said Section two (2), thence North along the West line of the Northeast Quarter of the Southwest Quarter, 20 chains, more or less, to the Northwest corner of the Northeast Quarter of the Southwest Quarter of said Section two (2), it also being the South city limit line of the City of Boonville, Missouri, as now located, thence East along the North line of the Southwest Quarter and the North line of the Southeast Quarter of said Section two (2) (City limit line) to the point of beginning, containing 92.00 acres, more or less, all situated in the South half (½) of Section two (2), Township forty-eight (48) North, Range seventeen (17), West 5th P.M. in Cooper County Missouri.

    (e)

    Pursuant to the special election held on August 26, 1975, the following territory is hereby annexed:

    Beginning at a point on the east line of Missouri State Highway Route "B," as presently located, where said east line intersects the North line of the Southeast quarter of Section 2, Township 48, Range 17, running thence in a southerly direction, along the said east line of said highway, to the north line of the public road known as Logan's Lake Road and/or Jackson Lane, running thence Westerly along the north line of said public road to the west line of said southeast quarter, thence North with said west line to the Northwest corner of the Southwest quarter of the Southeast quarter of said Section 2, thence East along the North line of the South half of said Section 2, to the West line of said Missouri State Highway Route "B," as presently located, thence North with the said West line of said highway to the North line of said Southeast quarter of said Section 2, thence East along said North line to the point of beginning, all located in the Southeast quarter of Section two (2), Township forty-eight (48) North, Range seventeen (17) West 5th P.M., Cooper County, Missouri.

    (f)

    Under the provisions of Section 71.014 RSMo., the city council of the City of Boonville, Missouri, hereby declares that the land hereinafter described be and is hereby annexed and embraced within the corporate limits of the City of Boonville, Cooper County, Missouri, and is and shall be a part of said city and that said tract being a part of Cooper County, Missouri, is more particularly described as follows, to wit:

    All that part of Section 25, Township 49, Range 17, in Boonville, Cooper County, Missouri, lying south of the Missouri River and west of the center line of Lilly's Branch and east of the following described line: Beginning at a point on the south line of said Section 25 a distance of 4,196.1 feet east of a stone at the southwest corner of said Section 25; thence north along a line making a northeast angle of 87 degrees 38 minutes 30 seconds with the south line of said Section 25 to the Missouri River;

    Also, the southwest fractional quarter of Section 30, Township 49, Range 16, containing 8.25 acres;

    Also, all that part of the southeast fractional quarter, Section 25, Township 49, Range 17, east of the middle of Lilly's Branch containing 14.25 acres;

    Excepting therefrom all that portion of the above-described tracts which lie north of the south line of the right-of-way of Missouri Pacific Railroad Company.

    (g)

    Under the provisions of Section 71.012 RSMo., the city council of the City of Boonville, Missouri, hereby declares that the land hereinafter described be and is hereby annexed and embraced within the corporate limits of the City of Boonville, Cooper County, Missouri, and is and shall be a part of said city and that said tract being a part of Cooper County, Missouri, is more particularly described as follows, to wit:

    Starting at the southeast corner of Section 4 Township 48 Range 17 thence west on section line 372 feet for the point of beginning, thence from point of beginning north 119.75 feet to an iron, thence west 90 feet to an iron, thence south 150 feet to an iron in corner of fence, said iron and fence corner being 32.09 feet south of section line of Sections 4 and 9, thence east 90 feet to an iron in fence, thence north 30.25 feet to the place of beginning, lying in the southeast quarter of Section 4, and the northeast quarter of Section 9 Township 48 North Range 17 west 5th P.M. Subject to easements, restrictions and covenants of record.

    (h)

    Under the provisions of Section 71.012 RSMo., the city council of the City of Boonville, Missouri, hereby declares that the land hereinafter described be and is hereby annexed and embraced within the corporate limits of the City of Boonville, Cooper County, Missouri, and is and shall be a part of said city and that said tract being a part of Cooper County, Missouri, is more particularly described as follows, to wit:

    A tract of land in the N ¼, of the NE ¼, of the SE ¼, of Section 2, T48N, R17W of Cooper County Missouri and being further described as follows:

    Starting at the NE corner of the NE ¼, of the SE ¼, of said Section 2, a found Missouri State Land Survey Monument, thence S0°42'12"E, 201.89 feet to a point, thence S89°34'00"W, 417.59 feet to an iron pin set, the point of beginning: Thence continuing S89°34'00"W, 237.00 feet to an iron pin set, thence leaving said line and following Missouri State Route B's R/W N41°47'46"W, 25.00 feet to a R/W marker, thence continuing along State Route B's R/W N11°16'12"E, 180.65 feet to an iron pin found, thence leaving said R/W N89°34'00"E, 200.00 feet to an iron pin set, thence S0°42'12"E, 201.89 feet to the point of beginning and containing 1.02 acres.

    (i)

    Under the provisions of Section 71.012 RSMo., the city council of the City of Boonville, Missouri, hereby declares that the land hereinafter described be and is hereby annexed and embraced within the corporate limits of the City of Boonville, Cooper County, Missouri, and is and shall be a part of said city and that said tract being a part of Cooper County, Missouri, is more particularly described as follows, to wit:

    A tract of land lying in the northwest quarter of Section 31, Township 49 North, Range 16 West and in the northeast quarter of Section 36, Township 49 North, Range 17 West in Cooper County, Missouri, described by metes and bounds as follows:

    Under the provisions of Section 71.012 RSMo., the city council of the City of Boonville, Missouri, hereby declares that the land hereinafter described be and is hereby annexed and embraced within the corporate limits of the City of Boonville, Cooper County Missouri, and is and shall be a part of said city and that said tract being a part of Cooper County, Missouri, is more particularly described as follows, to-wit:

    Beginning at the southeast corner of the north one-half of the southeast quarter of Section Two (2) Township Forty-eight (48), Range Seventeen (17), West 5th P.M., run thence north on section line 25.7 chains, thence west 9.47 chains to the Boonville and Tipton public road, thence with said road south 12 ½° west 20.88 chains, south 23° west 5.48 chains to the south line of the north one-half of the southeast quarter of said section, thence east on said line 16.10 chains to the point of beginning. Subject to easements and roads. Except that portion conveyed to K-C 1061, Inc. in Book 140, Page 29 and land to Marvin Lee Greis and wife in Book 154, Page 834, deep records of Cooper County, Missouri, and that portion deed to Central Missouri State Bank in Book 161, Page 253, Deed Records of Cooper County, Missouri.

    (k)

    Pursuant to the provision of Section 71.012 R.S. Mo. 1969 as amended by laws of 1980, the following described real estate is hereby annexed into the City of Boonville, Missouri, to-wit:

    Beginning at the point where the south present existing city limits of Boonville, Missouri, intersect the eastern highway right-of-way line of Missouri State Route B, said point located in the northeast quarter of the southeast quarter of Section Two (2), Township Forty-eight (48), Range Seventeen (17), thence southerly along said right-of-way line of Missouri State Route B as it runs through the northeast quarter of the southeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17); southeast quarter of the northeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17); northeast quarter of the southeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17), and the southeast quarter of the southeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17) to a point on the north right-of-way line of Interstate 70 where the eastern right-of-way line of Missouri State Route B intersects same, thence in a westerly direction along the north right-of-way line of Interstate 70, to a point where said Interstate 70 right-of-way line intersects the quarter section line between the southeast and southwest quarters of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17), thence northerly on said quarter section line 1050 feet more or less to a point on said quarter section line, thence east 808.5 feet to a stone as described in deed recorded in Book 172, Page 279, Cooper County Deed Records, thence in a northwardly direction a distance of 391.5 feet more or less to a point in the west right-of-way line of State Route B, thence northerly along said State Route B right of-way-line through the northwest quarter of the southeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17); northeast quarter of the southeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17); southeast quarter of the northeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17); and the northeast quarter of the northeast quarter of Section Eleven (11), Township Forty-eight (48), Range Seventeen (17) to a point where the western right-of-way line of State Route B intersects the existing south city limit line of the City of Boonville, thence in an easterly direction along the south city limit line to the point of beginning all being in Cooper County, Missouri.

    (l)

    Pursuant to the provision of Section 71.012 RSMo. 1969 as amended by laws of 1976, the real estate described in Exhibit A attached hereto and made a part hereof is hereby annexed into the City of Boonville, Missouri:

    A tract of land located in the SE ¼ of Section 2 and in the NE ¼ of Section 11, all in Township 48 North, Range 17 West, Cooper County, Missouri, said tract being eighty (80) feet wide and being forty (40) feet on each side of the following described line:

    Commencing at the SE corner of said Section 2-48-17; thence N87°13'W 1,190.91 feet to a point on the west right-of-way line of Missouri Route "B" at highway station 67 + 87.5, the point of beginning; thence with a 436.39-foot radius curve to the right an arc distance of 109.42 feet, said curve having a central angle of 14°22'; thence N80°47'40"W 71.49 feet; thence with a 436.30-foot radius curve to the left an arc distance of 197.50 feet, said curve having a central angle of 25°56'30"; thence S73°15'50"W 148.96 feet; thence with an 800.00-foot radius curve to the right an arc distance of 112.86 feet, said curve having a central angle of 8°05'; Thence S81°20'50"W 543.47 feet; thence S81°11'50"W 274.00 feet to a point on the west line of the SE ¼ of said Section 2-48-17, the end of this tract.

    (m)

    Pursuant to the provision of Section 71.012 RSMo. 1969 as amended by laws of 1976, the real estate described in Exhibit A attached hereto and made a part hereof is hereby annexed into the City of Boonville, Missouri, to-wit:

    The north forty (40) feet of the east six hundred (600) feet of the NE ¼ of the NW ¼ of Section 11, Township 48 North, Range 17 West, Cooper County, Missouri; and

    The south forty (40) feet of the east six hundred (600) feet of the SE ¼ of the SW ¼ of Section 2, Township 48 North, Range 17 West, Cooper County, Missouri.

    (n)

    Pursuant to the provisions of Section 71.012 RSMo 1969 as amended by laws of 1976, the real estate described to wit in Exhibit A attached hereto and made a part hereof, is hereby annexed into the City of Boonville, Missouri.

    The boundaries of the City of Boonville, Missouri are hereby altered so as to encompass the real estate described to wit in Exhibit A lying adjacent and contiguous to the present corporate limits:

    Part of the Southeast Quarter of the Southeast Quarter of Section 11, Township 48 North, Range 17 West, Cooper County, Missouri, more particularly described as follows:

    From the southeast corner of Section 11; thence N89°18'19"W, along the Section Line, 835.92 feet; thence N00°02'17"W, 660.00 feet to a point on the north right-of-way line of US Interstate 70; thence N05°35'23"W, 426.26 feet; thence S10°13'36"E, 150.00 feet; thence N79°48'33"W, 309.87 feet to a point on the easterly right-of-way line of Missouri State Route B; thence northerly, along the easterly right-of-way line of said Route B, on a spiral curve to the right, a distance of 150.00 feet, the chord of said spiral curve being N10°13'36"W, 150.00 feet; thence S79°48'33"E, 309.87 feet to the point of beginning. Containing 1.00 acre; and

    Part of the Southeast Quarter of the Southeast Quarter of Section 11, Township 48 North, Range 17 West, Cooper County, Missouri, more particularly described as follows:

    Pursuant to the provisions of Section 71.012 RSMo. 1969 as amended by laws of 1976, the real estate described to wit as:

    The north half of the north half of the northeast quarter of Section Eleven (11), Township Forty-eight (48) North, Range Seventeen (17) West of the 5th P.M., containing forty (40) acres, more or less. Subject to pipeline easements.

    Is hereby annexed into the City of Boonville, Missouri.

    The boundaries of the City of Boonville, Missouri are hereby altered so as to encompass the real estate described to wit as:

    The boundaries of the City of Boonville, Missouri are hereby altered so as to encompass the real estate described to wit in Exhibit A lying adjacent and contiguous to the present corporate limits.

    A tract of land located in the northeast ¼ of Section 14 and the southeast ¼ of Section 11, both in Township 48 North, Range 17 West, Cooper County, Missouri, being part of the land described by the trustee's deed recorded in Book 273, Page 396 and of the warranty deed recorded in Book 371, Page 44 of the records of Cooper County, and being more particularly described as follows:

    Commencing at the northeast corner of said Section 14 thence with the section line N 88°38′10" W 1387.01 feet to a point on the west right-of-way of State Route "B", the point of beginning.

    Thence from the point of beginning leaving said section line and with said west right-or way S 36°31′ 20" E, 61.76 feet; thence S 2°09′20" W 139.00 feet; thence leaving said west right-of-way N 89°43′45" W, 299.85 feet; thence S 1°25′20" E, 54.00 feet; thence N 85°13′50" W 250.00 feet; thence N 88°42′15" W 308.05 feet; thence N 6°55′20" E, 167.91 feet to a point on the south line of a plat by Carl Slagle dated June 29, 1960 and recorded in drawer 2 of said county records; thence with said south line S 85°13′5" E, 491.00 feet to the southeast corner of tract 2 of said plat; thence with the east line of said tract 2, N 16°34′55" W, 150.78 feet to the south right-of-way of Interstate Highway 70; thence with said south right-of-way S 82°54′50" E, 350.00 feet to the west right-of-way of said State Route "B", thence with said west right-of-way S 36°31′20" E 17.23 feet to the point of beginning and containing 3.62 acres (QT Inn; Tract #1)

    Pursuant to the provisions of Section 71.012 RSMo as amended, the real estate described to wit in Exhibit A attached hereto and made a part hereof, is hereby deannexed and detached from the City of Boonville, Missouri.

    The boundaries of the City of Boonville, Missouri are hereby altered so as to reflect this decrease in real estate described in Exhibit A.
