§ 4-34. Failure to control animals prohibited.

  • (1)

    It shall be unlawful for an owner or controlling party to fail to control any animal regardless of whether the animal is on or off a leash. Failure to control is the failure on the part of an owner, competent person or controlling party to properly govern the behavior of an animal to the point that the animal bites a person or other domestic animal or exhibits an unprovoked threat of attacking or biting a person, domestic animal or farm animal.

    (2)

    If an animal is impounded as a result of an owner or controlling party's failure to control, then all fees associated with impoundment shall be made payable to the city animal shelter in addition to any fines imposed by the court.
