§ 5-4.4. Construction in public utility easements.

  • (a)

    It shall be prohibited for any person, firm or corporation to construct, erect or install or to cause the construction, erection or installation of a permanent building and/or structure within a public utility easement or over a public utility.

    (b)

    Any person, firm or corporation who shall fail to comply with this provision shall be deemed guilty of an offense and upon conviction thereof, shall be punished by a fine not to exceed $100.00. Each day any such violation shall continue shall constitute a separate offense.
