§ 5-4.1. Penalty for failure to obtain building permit and for building code violations.

  • (a)

    If a person, firm or corporation shall commence work of any nature that shall require a building permit without obtaining the said building permit, and after so commencing work on a prior occasion without first obtaining a building permit, the fee to obtain said permit shall be two times the amount set forth in the fee schedule for said permit.

    (b)

    If any person, firm or corporation shall commence work without first obtaining a building permit, and said person, firm or corporation, or their authorized representative or agent, shall have obtained a building permit on a previous occasion, such person, firm or corporation shall be deemed to have actual or constructive knowledge that building permits are required within the City of Boonville, and the fee to obtain the said permit shall be two times the amount set forth in the fee schedule for said permit.

    (c)

    In the event any person, firm or corporation shall fail to obtain the necessary permit within one week after being notified in writing to do so by the building inspector, said person, firm or corporation shall pay, in addition to the customary fee or increased fee as above provided, the sum of $10.00 for each day in excess of the aforesaid one week that transpires prior to obtaining the necessary permit.

    (d)

    Any person, firm or corporation who shall violate any provision of the building codes of this city, or shall fail to comply with any of the requirements thereof, shall be guilty of an offense and shall be subject to the general penalty provisions of section 1-9 in addition to the increased fees above stated.
